These terms apply when you use the Nefesly app and the nefesly.com website. By installing and using the app you agree to these terms.

What Nefesly is

Nefesly is a sleep app that uses the phone's microphone at night to follow snoring and moments when breathing is not heard, and, if you want, places the night readings of your smartwatch and ring next to them. Its purpose is to help you see what happens during your night and, if needed, decide to see a doctor.

Not a medical device

Nefesly is not a medical device. It does not diagnose, monitor or treat any disease and does not replace a medical examination. Results are for information only. If you suspect sleep apnea, or have complaints such as excessive daytime sleepiness, morning headaches or witnessed pauses in breathing, see a doctor. Do not stop or change a treatment based on the app's results. In an emergency, call your local emergency number.

Who can use it

Nefesly is not intended for anyone under 16. If someone else is in the room, their voice may be recorded too; if you want to record your partner or anyone else, tell them first and get their consent. Listening to, publishing or sharing recordings without the other person's knowledge and consent is your responsibility.

Watches, rings and health apps

If you connect Apple Health, Health Connect or Huawei Health, the terms and privacy rules of those services also apply. Watch and ring readings vary by device and may be wrong; Nefesly does not guarantee their accuracy. Which data is read is listed on the Privacy page.

Research version

In the research version, given by invitation for scientific studies, the separate information and explicit consent text shown inside the app applies in addition to these terms. Taking part is voluntary and you can withdraw your consent at any time.

Intellectual property

The texts and drawings of the app and the website, the Nefesly name and logo belong to Nefesly. They may not be copied or distributed without permission except for personal use. Your recordings, notes and results belong to you.

Limitation of liability

Nefesly is provided as is. We do not guarantee that every night will be recorded, that every pause will be found or that the app will run without interruption; phone placement, battery settings and room noise affect the result. To the extent permitted by law, we are not liable for damages arising from decisions made based on the app's results. This section does not limit your statutory rights as a consumer.

Privacy

How data is processed is described on the Privacy page. In the store version your night recordings, notes and results stay on your phone.

Changes

If these terms change, the new version is published here with its date. If there is an important change, it is also stated in the app.

Governing law and contact
